The case succeeded by targeting design decisions the platforms made rather than content posted by users. In the UK, the Online Safety Act places duties on platforms to assess and mitigate the risk of harm from their services. For UK platform operators, the verdict is a prompt to document the reasoning behind engagement design decisions, ensure internal research on user harm is acted upon, and review whether governance frameworks reflect the standard that regulators and courts are beginning to apply.
